The Omgevingswet
Would you like to make changes to your living environment? For example, build a new home or commercial property, renovate your home, install a dormer window, or organize an event? If so, as the project initiator, you may need to deal with the “ Omgevingswet.” It’s important to check in advance which regulations apply to your plans.
Through the Omgevingsloket, you can check whether you need a permit, must file a notification, or can submit an application directly. You can also provide additional information here regarding a pending application.
You may also be affected by the “ Omgevingswet ” if someone else in your area has plans. For example, if neighbors want to build a structure or if a business in your neighborhood wants to expand. In that case, you may be considered an interested party in a permitting process.
The environmental plan
Every municipality has a " environmental plan" (Spatial Plan). This document sets out the rules governing the physical environment. These include rules regarding construction, the use of land and buildings, noise, soil, water, and sustainability.
Municipalities have until January 1, 2032, to adopt a single, comprehensive, and digital “ environmental plan .” Until then, the “ environmental plan ” consists of existing zoning plans, municipal regulations, and a number of national regulations. Step by step, we are consolidating these regulations into a single, coherent “ environmental plan.”
Permit Applications
The “ Omgevingswet ” ensures that the government makes a decision on your permit application more quickly. A “short procedure” is the default under the “ Omgevingswet.” Under a short procedure, the decision period is a maximum of 8 weeks. After that, you may still file an objection or an appeal. If your permit application is complex, it may fall under an “extended procedure.” In that case, the decision period is longer.
The “ Omgevingsdienst Rivierenland ” handles a large portion of the applications for environmental permits on behalf of the municipality.
