Quality Assurance Act for Construction

The Environment Act will come into force on January 1, 2024. At the same time as the Environment Act, the Quality Assurance Act for Construction (Wkb) will also be introduced. The aim of the Wkb is to improve construction quality. The WKB does not apply to all construction projects immediately. If you submit your building plans to the municipality after January 1, 2024, you must take the Wkb into account.

Before January 1, 2024, the municipality assessed in advance whether your building plan complied with the technical building regulations. From January 1, 2024, the municipality will no longer do this for low-risk buildings (Consequence Class I). This will be done by the quality assurance assessor, whom you hire yourself.

What does a quality assurance officer do?

The quality assurance officer assesses the construction quality during and after construction.

  • Before construction: the quality assurance officer checks whether the construction plan complies with the technical regulations.
  • During construction: the quality assurance officer inspects the construction.
  • After construction: if the construction complies with the regulations, the quality assurance officer will draw up a statement that you send to the municipality. 

Which structures fall under the Wkb?

The Wkb will apply to construction and renovation projects in consequence class 1 from January 1, 2024. The consequence class indicates the level of risk associated with a structure. Consequence class 1 covers low-risk structures, such as ground-level homes and simple commercial buildings. Houseboats, recreational homes, and industrial buildings with a maximum of two stories are also included in this class. There are also exceptions, including monuments.

What does it cost to hire a quality assurance specialist?

The costs of hiring a quality assurance specialist vary depending on the structure. The actual costs will have to be determined in practice.

Step-by-step plan for Wkb notification Consequence Class I

Step 1: hire a quality assurance specialist

You hire a quality assurance assessor yourself. You can find a list of quality assurance assessors on the website of the Construction Quality Assurance Admission Organization.

Step 2: Submit a building notification

You may only start construction once you have submitted a complete notification. At least four weeks before construction begins, you must submit the construction notification via the Omgevingsloket:

  • Go to ‘Requests’.
  • Under "Activities," select "Construction activity."
  • Select 'Construction activity (technical) Notification'.

Here you also indicate who your quality assurance officer is. Provide the other information requested as well. Is any information missing? Then you will need to submit a new notification. Four weeks after submitting the notification, you may start construction.

Step 3: Start construction

Two days before construction begins, you must report this via the Omgevingsloket(Environment Desk) . This is called the duty to provide information.

Step 4: inspection by quality assurance officer

The quality assurance assessor checks before and during construction whether the building regulations are being complied with. You will receive a statement from the quality assurance assessor if the building complies with the building regulations.
Please note: The municipality can also check whether the building regulations are being complied with. It can also enforce compliance if this is not the case. The quality assurance assessor cannot do this.

Step 5: Report the completion of construction

One day after stopping construction, you must report this via the Omgevingsloket(Environment Desk) . This is mandatory.

Step 6: submit a completion report

You may only use the structure once you have submitted a complete completion report. You must do this at least two weeks before you wish to start using the structure. This can be done via the environmental desk. You will need the quality assurance statement (step 4) for this.

The municipality will indicate whether your completion notification has been accepted or rejected.
