Construction Quality Assurance Act

The Omgevingswet will take effect on January 1, 2024. Along with the Omgevingswet , the Construction Quality Assurance Act (Wkb) Omgevingswet also introduced. The purpose of the Wkb is to improve construction quality. The Wkb does not apply immediately to all structures. If you submit your building plans to the municipality after January 1, 2024, you must take the Wkb into account.

Prior to January 1, 2024, the municipality conducted a preliminary review to determine whether your building plan complied with building codes. As of January 1, 2024, the municipality will no longer perform this review for low-risk structures (Consequence Class I). This task will be handled by a quality assurance professional, whom you must hire yourself.

What does a quality assurance specialist do?

The quality assurance specialist assesses construction quality during and after construction.

  • Before construction begins: the quality assurance officer verifies that the construction plan complies with technical regulations.
  • During construction: the quality control inspector oversees the construction.
  • After construction: if the construction complies with the regulations, the quality assurance officer will issue a certificate that you will send to the municipality. 

Which structures are covered by the Wkb?

The Wkb will apply to new construction and renovation projects in consequence class 1 starting January 1, 2024. The consequence class indicates the level of risk associated with a structure. Consequence class 1 includes low-risk structures, such as single-family homes and simple commercial buildings. This also includes houseboats, vacation homes, and industrial buildings with a maximum of two stories. There are also exceptions, including historic buildings.

How much does it cost to hire a quality assurance specialist?

The cost of hiring a quality assurance specialist varies depending on the structure. The actual costs will have to be determined based on practical experience.

Step-by-Step Guide for Wkb Reporting: Consequence Class I

Step 1: Hire a quality assurance specialist

You are responsible for hiring a quality assurance provider. You can find a list of quality assurance providers on the website of the Construction Quality Assurance Accreditation Organization (TOEK) at .

Step 2: Submit a building notification

You may not begin construction until you have submitted a complete notification. At least 4 weeks before construction begins, you must submit the construction notification via the Omgevingsloket:

  • Go to "Requests."
  • Under “Work,” select “Construction activity.”
  • Select “Construction Activity (Technical) Report.”

Here, you should also indicate who your quality assurance representative is. Please provide all other requested information as well. If any information is missing, you must submit a new notification. You may begin construction four weeks after submitting the notification.

Step 3: Start construction

Two days before construction begins, you must submit this information via the Omgevingsloket at . This is known as the duty to provide information.

Step 4: Review by a quality assurance specialist

The quality assurance inspector checks before and during construction to ensure that building codes are being followed. You will receive a certificate from the quality assurance inspector if the structure complies with building codes.
Please note: The municipality can also verify compliance with building codes. It can also take enforcement action if compliance is not met. The quality assurance inspector cannot do this.

Step 5: Notify us when construction is complete

One day after construction has stopped, you must report this via the Omgevingsloket at . This is mandatory.

Step 6: Submit a completion report

You may not use the structure until you have submitted a complete notification of completion. You must do this at least 2 weeks before you intend to start using the structure. This is done through the Environmental Permit Desk. You will need the quality assurance statement (step 4) for this.

The municipality will let you know whether your completion notice has been accepted or rejected.
