What is it?

Planning damage occurs when a house or plot of land loses value due to a zoning plan or environmental plan. For example, if the municipality builds a highway near a residential area. In that case, you can apply for financial compensation from the municipality.

For new decisions taken under the Environment Act from January 1, 2024, planning damage will be replaced by compensation for loss. 

How does it work?

Planning damage can arise in two ways:

  • Your house or property has decreased in value as a result of the plan. We refer to this as a reduction in the value of immovable property.
  • Your business has less income because of the plan. We call this loss of income.

Compensation

To be eligible for compensation, two things are important:

  • You could not have anticipated the damage when you purchased the house or land.
  • You have not received any other compensation.

You will receive compensation if it is not fair that you should have to pay for the damage yourself or if the damage is not insured.

An excess of (at least) 2 percent applies to:

  • depreciation of the immovable property
  • loss of income

What should I do?

You apply for compensation from the municipality. Please include the following in your application:

  • why you are requesting compensation
  • how much compensation you want
  • which spatial plan caused the damage (e.g., the zoning plan)
  • a description of the damage
  • the amount of damage
  • in the event of damage to immovable property: cadastral number
  • your bank account number

Please note: you must apply for the allowance within 5 years after the spatial plan has been finalized.

You must pay€300.00 to submit a claim for compensation. You will only be refunded this amount if compensation is actually awarded.

How long will it take?

  • The procedure for compensation takes an average of 1 to 1.5 years.
  • If you disagree with the decision, you can lodge an objection.
