What is fire-safe use?

For certain buildings (e.g., a daycare center, café, or hotel), you need an environmental permit for fire safety. The municipality will then impose additional fire safety requirements on a building if necessary. These requirements prevent fires, fire hazards, and accidents in the event of a fire.

Reporting buildings or temporary structures

For some buildings, you must submit a notification for fire safety use to the municipality. This applies, for example, to buildings that can accommodate at least 50 people at the same time. It also applies to temporary structures, such as site huts. You can submit the notification to the municipality free of charge.

Reporting sites and other locations

There is a national regulation for fire safety and basic emergency response in other locations (Bbgbop). The purpose of this regulation is to improve fire safety in places where large numbers of people gather. Examples include event venues, campsites, and marinas. You are then required to report this to the municipality.

How does it work?

In these cases, you must apply for an environmental permit for fire-safe use:

  • You offer sleeping accommodations for more than 10 people. For example, in a hotel, guesthouse, hospital, or nursing home.
  • During the day, there are more than 10 people under the age of 12 in the building. For example, in a primary school or daycare center.
  • During the day, there are more than 10 people with physical or mental disabilities present in the building. For example, at a day care center.

Please note! If you do not apply for an environmental permit for fire safety, when you should have done so, you are liable to prosecution.

Notification

If there are at least 50 people in a building at the same time, you must report this for fire safety purposes. This includes:

  • educational buildings for secondary and higher education (for children over 12 years of age and adults) 
  • light industry, such as warehouses, stables, or greenhouses
  • offices, such as bank buildings, town halls, or county offices
  • meetings in, for example, convention centers, churches, community centers, or theaters
  • swimming pools, gyms, sports halls, or fitness centers
  • shopping centers, department stores, supermarkets, station buildings, or stores at gas stations

What do I need?

  • As an entrepreneur, you need eHerkenning and your Chamber of Commerce registration number.
  • As a private individual, you will need your DigiD.

How long will it take?

  • For a permit: 6 months. The municipality may extend this period by 6 weeks.
  • For a notification: your notification and accompanying documents must be submitted at least 4 weeks before you start using the building, structure, or site.

Objection or appeal

  • If you disagree with the municipality's decision regarding your permit, you can lodge an appeal with the court within six weeks. This is only possible if you have also submitted an opinion on the draft decision.
  • If you disagree with the decision regarding your report, you can lodge an objection with the municipality within six weeks.
