Lodge an objection
You may disagree with a decision made by the municipality. For example, because you applied for a permit but did not receive it. Or your neighbors received a permit that you disagree with. In that case, you can file an objection.
How does it work?
- The municipality's decision states whether you can lodge an objection.
- Ensure that your objection is received by the municipality within 6 weeks. This period begins on the day after the date on which the decision was sent to the applicant. You can find the decision underMessages about your neighborhood.
- Send your objection to the municipality.
- The municipality may ask you to come in to discuss your objection.
- The municipality will decide on your objection within 12 weeks. The municipality may extend this period by 6 weeks.
What should I do?
- Before lodging an objection, ask the Legal Desk, your legal aid insurer, or a lawyer for advice.
- You can submit an objection by sending a letter of objection to the municipality. There are two ways to do this:

By sending a letter to the municipality. Send it to PO Box 1, 6658ZG Beneden-Leeuwen. Describe your objection in detail. Include the case number or reference number. Do you have any documents you would like to share with us to explain why you disagree with the decision? If so, please enclose them with your letter.
How long will it take?
- The municipality will decide on your objection within 12 weeks.
- The municipality may extend this period by six weeks. You will always be notified of this.
Apply for provisional relief
Have you lodged an objection? Then you must wait for the decision. In some cases, you cannot wait for this. You can then submit arequest for a provisional measureto the court. With a provisional measure, you are requesting a provisional decision from the court.
You must submit your request to the Gelderland District Court, Administrative Law Division (PO Box 9030, 6800 EM Arnhem)
You will be required to pay court fees to apply for a provisional measure. You can obtain more information about this from the court.
File an appeal
If the municipality has rejected your objection, you can see in the decision whether youcan lodge an appeal with the court. You must submit your appeal within 6 weeks.
Appeals Committee of the Municipality of West Maas en Waal
The Appeals Committee is an independent committee of experts that advises the council on decisions regarding appeals. This completely independent committee meets once a month. The committee consists of four external members who do not work for our municipality.
