Objection to the WOZ value

The Rivierenland Tax Cooperation (BSR) is responsible for determining the WOZ value for our municipality. If you disagree with the WOZ value, you can file an objection with the BSR. For more information, visit westmaasenwaal.nl/woz-waarde.

You may disagree with a decision made by the municipality. For example, you may have applied for a permit but were denied. Or your neighbors may have been granted a permit that you disagree with. In that case, you can file an objection.

How does it work?

  • The municipality's decision states whether you can file an objection.
  • Make sure your appeal is received by the municipality within 6 weeks. This period begins on the day after the decision was sent to the applicant. You can find the decision at“News about your neighborhood”.
  • Please send your objection to the municipality.
  • The municipality may ask you to come in to discuss your objection.
  • The municipality will decide on your appeal within 12 weeks. The municipality may extend this period by 6 weeks.

What should I do?

  • Before filing an objection, ask the Legal Help Desk, your legal expenses insurer, or a lawyer for advice.
  • You can file an objection by sending a written objection to the municipality. There are two ways to do this:

    By sending a letter to the municipality. Send it to Postbus . Postbus , 6658ZG Beneden-Leeuwen. Describe your objection in detail. Include the case number or reference number. Do you have any documents you’d like to share with us to explain why you disagree with the decision? Please include them with your letter.

How long does it take?

  • The municipality will make a decision on your appeal within 12 weeks.
  • The municipality may extend this period by 6 weeks. You will always be notified of this.

Request a preliminary injunction

Have you filed an objection? If so, you must wait for the decision. In some cases, you cannot wait for that decision. In such cases, you can file arequest for a preliminary injunctionwith the court. With a preliminary injunction, you are asking the court for a temporary ruling.

You must file your request with the Gelderland District Court, Administrative Law Division (Postbus .Postbus , 6800 EM Arnhem)
. You are required to pay a court filing fee to request a preliminary injunction. You will receive further information about this from the court.

File an appeal

If the municipality has rejected your objection, the decision will indicate whether youcan file an appeal with the court. You must file your appeal within 6 weeks.

Objections Committee Municipality of West Maas en Waal

The Appeals Committee is an independent panel of experts that advises the municipal council on decisions regarding appeals. This fully independent committee meets once a month. The committee consists of four external members who do not work for our municipality.
