What is it?

Sometimes the municipality has a plan or makes a decision that you disagree with. In that case, you can share your opinion. This opinion is called a “statement of views.” For example, you can submit a statement of views if your neighbor has plans to build and you disagree with them. Or if you disagree with a new zoning plan proposed by the municipality.

How does it work?

You can only submit comments on draft decisions and draft plans. These are plans that have not yet been approved. The municipality announces new plans or decisions via its website and door-to-door newsletters. The municipality can still amend the decision at this stage. The municipality may therefore incorporate your opinion into the final decision. But it is not required to do so. Various people may be affected by the plan or decision. The municipality considers their interests and then makes a decision.

You can submit a statement on behalf of someone else. However, you will need authorization from that person.

What should I do?

You may submit your comments in writing or orally. Oral submissions are only permitted if this is specified in the notice.

Are you submitting your comments in writing? Please include the following in your statement:

  • your name, address, and email address
  • the draft plan or draft decision with which you disagree (for example, please include a copy of the draft or note the case number)
  • why you disagree with the proposal
  • the date on which you write the statement
  • your signature
  • if necessary, a written authorization with a signature

Would you like to submit your comments in person? If so, please make an appointment with the municipality. The municipality will prepare a report of your oral comments. You will be asked to sign this report.

Objections and Appeals

You may appeal the final decision if you have previously submitted your comments. You must file your appeal with the district court. If the matter concerns a zoning plan, you must file your appeal with the Council of State.

You have 6 weeks to file the appeal.

If you disagree with the court’s ruling on your appeal, you may file an appeal with the Council of State.
