What is it?

Sometimes the municipality has a plan or makes a decision with which you disagree. In that case, you can express your opinion. This opinion is called a statement of opinion. You can submit your statement of opinion if, for example, your neighbor has building plans and you disagree with them. Or if you disagree with a new zoning plan proposed by the municipality.

How does it work?

You can only submit an opinion on draft decisions and draft plans. These are plans that have not yet been approved. The municipality will announce new plans or decisions on its website and in local newspapers. The municipality can still amend the decision at this stage. The municipality may therefore incorporate your opinion into the final decision. However, it is not obliged to do so. Various people may be affected by the plan or decision. The municipality will consider their interests and then make a decision.

You can submit an opinion on behalf of someone else. However, you will need authorization from that person.

What should I do?

You may submit your opinion in writing or verbally. Verbal submissions are only permitted if this is stated in the publication.

Are you submitting it in writing? Include the following in your opinion:

  • your name, address, and email address
  • the draft plan or draft decision with which you disagree (for example, send a copy of the draft or write down the file number)
  • why you disagree with the design
  • the date on which you write the opinion
  • your signature
  • possibly a written authorization with signature

Would you like to submit your opinion verbally? If so, please make an appointment with the municipality. The municipality will draw up a report of your verbal opinion. You will then sign this report.

Objections and appeals

You can appeal against the final decision if you have previously submitted your opinion. You can lodge an appeal with the court at . If it concerns a zoning plan, you can lodge an appeal with the Council of State at .

You have six weeks to submit the appeal.
