West Maas en Waal Considers Next Steps After Preliminary Injunction Ruling

Yasemin Groep has initiated summary proceedings against the Municipality of West Maas en Waal. The case concerns the validity of an agreement concluded between the municipality and the Yasemin Groep. On December 22, the court in Arnhem ruled in favor of the Yasemin Groep.  

The agreement covers three locations: Altforst, Wamel Maasbommel. Maasbommel the subject of this preliminary injunction proceeding. 
The preliminary injunction concerns the content of the agreement and whether there is a reservation. This reservation pertains to the municipal council approval municipal council the location and the obtaining of an environmental permit for the location. The court has ruled that the municipality must comply with the agreement.

Alderman van den Boom-Witzel: “The judge has issued a ruling. Local residents were the first to be notified of the verdict. We will use the Christmas break to determine what steps we will take.”
