West Maas en Waal partially equalized

On March 18, 2024, the preliminary relief proceedings brought by the Jasmin Group against the municipality of West Maas en Waal took place. The ruling was handed down on March 28.

The Jasmin Group demanded the following:

  1. Compliance with all (legal) acts arising from the lease agreement, more specifically actually housing 35 Ukrainians in Maasbommel and 50 in Wamel;
  2. A monthly payment of €271,000 for the leased premises, commencing on February 1, 2024, and continuing for the duration of the lease agreement;
  3. Payment of the arrears amounting to €767,443, as well as the extrajudicial costs;
  4. Payment of the costs of the preliminary relief proceedings;

The court ruled partially in favor of the Jasmin Group. The demand to actually house 85 Ukrainian refugees at Raadhuisdijk 18 in Maasbommel and Wilhelminastraat 9 in Wamel was rejected. The third demand, payment of an alleged arrears of €767,443, was reduced by the judge to €177,126.50. However, the court did order the municipality to make a monthly payment of €272,922.67.

Alderman Marieke van den Boom-Witzel: "Until now, we paid rent for 85 people in Wamel and Maasbommel. This ruling means that we will also have to pay for catering and service for 85 people, even though this is not provided by the Jasmin Group. Next week, we will consult and consider further steps."
