Temporary rental of vacant property

What is it?

You may temporarily rent out your vacant property. For example, if your home or office building has been on the market for a while or is scheduled for demolition. To do so, you must apply for a permit from the municipality.

How does it work?

You can apply for the permit for the following vacant properties:

  • a home that is for sale and has never been lived in
  • a home that is for sale and in which the owner lived during the 12 months before it became vacant
  • a home that is for sale and has been rented out for no more than 3 years over the past 10 years
  • a rental property that is being demolished or renovated
  • a rental property that is for sale
  • a building not intended for residential use (such as an office, school, or group housing facility)

When will you receive the permit?

  • property currently for sale: 5 years
  • rental property that is being demolished or renovated: 2 years (extendable to a maximum of 7 years)
  • Housing in an office, school, or group housing: 2 years (extendable to a maximum of 10 years)
  • residential property for which you have an exemption from the environmental plan: for the duration of the exemption (up to 10 years)

What should I do?

Please note! Is the validity period of your current permit for your home that is currently for sale less than 5 years? If so, you do not need to renew it. Your permit is still valid for 5 years. You can ask the municipality to confirm this.

The permit costs€164.00.

What do I need?

On the application form, please provide the following information:

  • your personal information
  • information about the building or residence where you wish to rent out space
  • tenant's information
  • Description of the space you wish to rent out
  • the reason for your request
  • whether you have a permit under the Housing Act, such as a conversion permit or a subdivision permit

Additional information

Have you been granted a permit for temporary rental? In that case, the standard rent control rules generally do not apply. However, the rules under the Vacancy Act do apply:

  • The tenant has no rent protection when the lease ends.
  • The lease is for a minimum of 6 months.
  • The tenant must give at least one month's notice.
  • The landlord must give at least 3 months' notice.
  • The lease terminates when the vacancy permit expires.

Rent

If you receive a permit to rent out your home while it is on the market, you may agree on the rent with the tenant. In all other cases, the rent may not exceed the amount specified in the permit.
