Didam ruling
In November 2021, the Supreme Court ruled on the Didam case: the Didam judgment. This judgment relates to the disposal of immovable property by the government. When disposing of immovable property, municipalities must observe the principle of equality. This means that all (potential) candidates must be offered equal opportunities for acquisition.
In most cases, the municipality is therefore obliged to offer immovable property for sale publicly and to communicate transparently about this. There are a number of exceptions that allow for one-to-one sales of immovable property.
In all cases, the municipality must publicly announce any (planned) land sale. Below, you can find all plans to sell municipal real estate. This also includes the municipality's motivation for entering into an agreement with a party.
