Subdivision and Repurposing of Commercial Properties
Do you own a company-owned residence and want to subdivide or repurpose it? Below are the options available for each type of company-owned residence.
By "spin-off," we mean that the property is no longer part of the company.
In the case of "repurposing," the property takes on a different function and can be used as a regular residence.
Options by type of company housing
A company-owned residence at a regular company
If the company residence is located on an industrial park, it cannot be separated from the business or repurposed. This is because we want to give businesses the opportunity to expand. This applies to businesses that, according to the environmental plan, are located within an industrial park.
If the company residence is located in the center of a village, this is often the result of historical development.
Repurposing the business and the business residence is possible. Separating the business residence from the business is also possible.
Relocating the business to an industrial park is preferred.
Company housing at a regular business in a rural area
This concerns non-agricultural businesses. These businesses often originated from an agricultural business—first as a side business, and later as a fully non-agricultural business.
It is possible to spin off or repurpose this type of business property.
Company housing on a farm
Agricultural businesses are mainly located in rural areas (river floodplains and valley basins).
- Does an agricultural business have animals? If so, continuous supervision is required. In this case, it is not possible to separate or repurpose a farm residence.
- For a farm without livestock, a farmhouse is usually desirable for efficient farm management. However, it is possible to separate or repurpose this farmhouse.
- Is there a second company-owned residence? If so, it is possible to either split off the property or repurpose it.
Company housing associated with a central function
Is the property a company-owned residence located in a commercial zone in Beneden-Leeuwen Dreumel? If so, subdivision and rezoning are possible.
Is this a standalone commercial or retail property? Often, these are residential units within a building, and subdivision and repurposing are not typically considered. However, subdivision and repurposing are possible in these types of situations.
Company housing at a recreational facility
There are a number of (large-scale) recreational businesses that have traditionally owned company housing. It is not possible to subdivide or repurpose this company housing.
New recreational developments are not eligible for a company-provided residence because it is not necessary to live on the premises.
Company-owned housing and the Omgevingswet
The Environmental Plan will specify the rules governing the use of former company-owned residences. The guidelines set forth in the Living Environment Quality Decree (Bkl) also apply. These rules apply to former company-owned residences on industrial parks and to those associated with hospitality and agricultural businesses. The rules are intended to protect all former company-owned residences from the environmental impacts of business activities, such as noise, vibrations, odors, and shadow flicker.
